This agreement is between you and Digital Innovations LLC. By accessing or using Gallspace (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Gallspace is a professional photography portfolio platform that allows photographers to create galleries, manage contacts, and share protected galleries with clients.

2. Account Terms

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Be responsible for all activity under your account
• Be at least 13 years of age

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

3. Acceptable Use

You agree not to use the Service to:

• Upload, share, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe on the intellectual property rights of others
• Upload malware, viruses, or other harmful code
• Attempt to gain unauthorized access to other accounts or systems
• Use the Service for spam, phishing, or other deceptive practices
• Interfere with or disrupt the integrity or performance of the Service
• Violate any applicable laws or regulations

4. Content Ownership and Rights

You retain all ownership rights to the photos, videos, and other content you upload to the Service ("Your Content"). By uploading content, you grant Digital Innovations LLC a limited, non-exclusive license to store, display, and distribute Your Content solely for the purpose of operating and providing the Service.

4.2 Our Content

The Service, including its design, features, and functionality, is owned by Digital Innovations LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

4.3 Content Responsibility

You are solely responsible for Your Content and the consequences of uploading or sharing it. We do not endorse or guarantee the accuracy of any user content.

5. Subscriptions and Payments

5.1 Plans and Pricing

Gallspace offers both free and paid subscription plans. Features and storage limits vary by plan. We reserve the right to modify pricing with reasonable notice to subscribers.

5.2 Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). Payment is processed securely through Stripe. You authorize us to charge your payment method for recurring subscription fees.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6. Gallery Sharing

The Service allows you to share galleries with clients using password protection and direct links. You are responsible for:

• Managing access to your galleries
• Setting appropriate passwords for protected galleries
• Ensuring you have the right to share any content in your galleries
• The privacy and security of gallery links and passwords you distribute

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• Your data will be retained for 30 days before permanent deletion
• You may request a copy of your data before deletion by contacting us

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data, including photos and other content you upload.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL INNOVATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Digital Innovations LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content uploaded to the Service

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
